These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Ambient Bible ("we," "us," or "our") governing your access to and use of the website located at ambientbible.comand any related applications, services, APIs, content, tools, and features (collectively, the "Service").

BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, YOU MUST NOT ACCESS OR USE THE SERVICE.

1. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Ambient Bible provides access to biblical scripture texts, audio narrations, pronunciation guides, prayer resources, study materials, and related content. The Service may also include an application programming interface ("API") for programmatic access to certain data and content.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you.

3. Scripture & Content

3.1 Public Domain Texts

The biblical texts provided through the Service (including but not limited to the King James Version, American Standard Version, World English Bible, Reina-Valera 1909, Louis Segond 1910, Luther 1912, Chinese Union Version, Smith & Van Dyke Arabic, Synodal Russian Translation, Darby Translation, Young's Literal Translation, and the Latin Vulgate) are in the public domain. You may freely use these texts subject to applicable law.

3.2 Original Content

All other content on the Service, including but not limited to audio narrations, musical compositions, sound design, visual artwork, illustrations, photography, website design, user interface elements, code, pronunciation guides, commentary, study materials, prayer compositions, metadata, compilations, and arrangement of public domain materials, is the exclusive property of Ambient Bible or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, download, store, transmit, or otherwise exploit any original content from the Service without our prior written consent, except as expressly permitted by these Terms or applicable law.

3.3 Audio Content

Audio narrations, musical beds, sound design, and all audio productions available through the Service are original works owned by Ambient Bible. Streaming is permitted through the Service. Downloading, ripping, re-uploading, redistribution, sampling, remixing, or any other unauthorized reproduction of audio content is strictly prohibited.

4. API Terms

4.1 API Access

If we provide API access, your use of the API is subject to these Terms and any additional API-specific terms, documentation, or policies we publish. We may require registration and issuance of API keys.

4.2 Rate Limits & Quotas

API access is subject to rate limits, quotas, and usage restrictions as published in our API documentation. Exceeding these limits may result in throttling, suspension, or termination of your API access.

4.3 Prohibited API Uses

You agree not to use the API to:

• Build a competing service or substantially replicate the Service;
• Redistribute, resell, or sublicense API access or API-derived data;
• Circumvent rate limits, authentication, or access controls;
• Scrape, crawl, or bulk-download content beyond what the API expressly provides;
• Use API data for training machine learning models without explicit written permission;
• Misrepresent API-sourced content as your own original work;
• Use API access for any unlawful purpose.

4.4 Attribution

If you use data obtained through the API in any public-facing application, you must provide clear and prominent attribution to Ambient Bible, including a link to ambientbible.com, unless we have provided written permission to omit attribution.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or malicious purpose;
• Attempt to gain unauthorized access to any part of the Service, other users' accounts, or our systems;
• Interfere with or disrupt the Service, servers, or networks connected to the Service;
• Use automated means (bots, scrapers, spiders) to access the Service except through our authorized API;
• Reverse-engineer, decompile, or disassemble any part of the Service;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Transmit any viruses, malware, or other harmful code;
• Harvest, collect, or store personal information of other users;
• Impersonate any person or entity or misrepresent your affiliation;
• Use the Service in any manner that could damage, disable, overburden, or impair it;
• Reproduce or redistribute content from the Service (except public domain scripture text) without written authorization.

6. User Submissions

If you submit any content, feedback, suggestions, or ideas to us (collectively, "Submissions"), you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully sublicensable right to use, reproduce, modify, adapt, publish, distribute, and display such Submissions for any purpose without compensation or attribution to you. You represent that you have the right to make such Submissions and that they do not infringe any third-party rights.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT, INCLUDING SCRIPTURE TEXTS, PRONUNCIATION GUIDES, AUDIO NARRATIONS, OR STUDY MATERIALS.

THE SERVICE IS NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL THEOLOGICAL, SPIRITUAL, LEGAL, MEDICAL, OR OTHER EXPERT ADVICE. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE AND ITS CONTENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AMBIENT BIBLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (US $100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Ambient Bible and its officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your use of the Service caused damage to a third party. This indemnification obligation survives termination of these Terms.

10. DMCA & Copyright Notices

We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please send a notice to our designated agent at hello@ambientbible.com with the following information:

• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material claimed to be infringing and its location on the Service;
• Your contact information (name, address, email, phone number);
• A statement that you have a good faith belief the use is not authorized;
• A statement under penalty of perjury that the information is accurate and you are the copyright owner or authorized to act on behalf of one;
• Your physical or electronic signature.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.

Arbitration:Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall take place in New York, New York, or at another mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Class Action Waiver:YOU AND AMBIENT BIBLE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

Exceptions: Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights. Claims eligible for small claims court may be brought there instead of arbitration.

13. Severability

If any provision of these Terms is held to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us to be effective.

15. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published on the Service, constitute the entire agreement between you and Ambient Bible regarding the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.

16. Assignment

You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction. Subject to the foregoing, these Terms bind and inure to the benefit of the parties and their respective successors and assigns.

17. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, pandemic, natural disaster, power failure, internet or telecommunications failure, government action, or labor disputes.

18. Changes to These Terms

We may revise these Terms at any time by updating this page. Changes are effective upon posting. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If changes are material, we will use reasonable efforts to provide notice (e.g., a banner on the Service). It is your responsibility to review these Terms periodically.
